Land plot is a part of the earth's surface that has certain boundaries and area. The plot may belong to several owners, in connection with which there may be a need for its distribution among co-owners.

 

Distribution or allocation of land

Any distribution must be made in such a way that each co-owner can own and dispose of his part of the land without violating the rights and interests of other co-owners. This distribution allows each co-owner to obtain a separate state act for its part and dispose of the land at its discretion (sale, gift, pledge and other civil actions).

Allocation of part of the land should be carried out when there are more than two co-owners. In this case, one co-owner is separated, and the others remain in joint partial ownership.

When dividing, all co-owners must be divided among themselves regardless of their number.

 

Determining the order of land use

Not all land plots have been privatized. If the site is in use, it is incorrect to talk about its distribution. In this case, the established procedure for use must be applied. The court or the owners themselves can determine the order of land use. In order to do this legally, it is necessary to conduct a land technical examination.

 

Approximate list of required documents:

  • legal documents for the land plot (State act or decision on transfer for use);
  • title documents for the house;
  • technical passport for the house;
  • information on the procedure for using the premises of the house and outbuildings;
  • information on shares of co-owners.

 

 

 

 

Terms of service

The approximate terms are:

  • for forensic examinations - 60 days;
  • for expert research - 10 days.

The exact terms will be calculated at the time of order, taking into account the scope of the study and the current workload of specialists within the limits provided for paragraph 1.13. Section I "Instructions on the appointment and conduct of forensic examinations and expert research", approved by the Order of the Ministry of Justice of Ukraine 08.10.1998 № 53/5.
