Construction and technical examination is a type of examination that involves a special study to determine the technical condition of the object of examination or expert study (hereinafter - the object), the quality of construction work performed on the site, the safety of operation of the object, determining the causes of deformation of individual elements of building structures, as well as whether the construction of the object meets the technical standards, design documentation and project estimates.

 

The main tasks of construction and technical expertise are:

  • determining the compliance of the developed design, technical and estimate documentation with the requirements of regulations in the field of construction;

  • determination of compliance of performed construction works and constructed real estate objects (buildings, structures, etc.) with design and technical documentation and requirements of normative legal acts in the field of construction;

  • determination of compliance of the performed construction works, separate elements of real estate objects, constructions, products and materials with design and technical documentation and requirements of normative-legal acts in the field of construction;

  • determination, verification of volumes and cost of performed construction works and compiled primary reporting documentation on construction and their compliance with design and estimate documentation, requirements of regulations in the field of construction;

  • determination of the capital group, complexity category, degree of fire resistance of buildings and structures and degree of construction readiness of unfinished objects;

  • determination of the technical condition of buildings, structures and engineering networks, the causes of damage and destruction of objects and their elements;

  • determining the cost of construction work related to re-equipment, elimination of the consequences of flooding, fire, natural disaster, mechanical impact, etc.;

  • identification of opportunities and development of options for distribution (allocation of shares; order of use) of real estate.

 

Objects of construction and technical examination may be: houses, buildings, apartments, building materials, structures and parts, areas functionally related to construction sites, design and estimate, executive documentation and documents that contain information about operation of the facility and which have become the subject of litigation, etc.

 

The procedure and grounds for the appointment of construction and technical expertise

Construction expertise may be appointed by a court or pre-trial investigation bodies in the event of a conflict situation, as well as in cases of distribution of land or residential building. The examination involves a full or partial technical inspection of the object. The examination reveals what construction technologies and tools were used to implement the object.

The basis for the examination in accordance with applicable law is a procedural document on the appointment of the examination, drawn up by an authorized person (authority), or an agreement with an expert or expert institution, concluded at the written request of the person in cases provided by law. case number or criminal proceedings or a reference to the article of the law, which provides for the provision of an expert opinion, a list of issues to be resolved, as well as objects to be investigated. The results of the examination are set out in a written document - the expert's opinion.

 

Forensic construction and technical expertise is a procedural action, which consists in conducting research and providing an expert opinion on issues that are subject to proof in a particular case (civil, commercial, administrative) or in criminal proceedings. The court makes a decision on the appointment of the examination (Art. 104 CPC), in which it indicates the grounds for the examination, the issues on which the expert must provide the court with an opinion, the person (persons) entrusted with the examination, the list of materials provided for the study, and other data relevant to the examination. The decision on the appointment of the examination is sent to the persons entrusted with the examination and the participants in the case. The objects and materials to be examined are sent to the person entrusted with the examination (leading expert or expert institution). Construction and technical expertise takes place in this cases:

Construction and technical expertise allows you to establish the presence or absence of inaccuracies in the implementation of the project by builders. During the construction examination, special methods are used, tested and approved by regulatory authorities. The timing of the construction examination is carried out depending on the scale of the object. The results of the construction examination may, if necessary, be submitted to the court and considered as evidence in the case. In preparation for the appointment of construction and technical examination and formulation of questions, the person who appoints the examination must provide the expert with materials that are the objects of examination.

  • on compliance of the developed design and estimate documentation with the requirements of normative legal acts in the field of construction (state building codes (SBC or in native - DBN), building codes and regulations (SNiP), etc.);
  • compliance of actually performed construction works with project documentation and requirements of normative legal acts in the field of construction;
  • determination of the list and volumes of actually performed works on construction (repair, reconstruction) of objects;
  • determination of the cost of actually performed works on construction of objects; determination of conformity of volumes and cost of actually executed construction works to the volumes and cost determined by the design-estimate or primary reporting documentation;
  • compliance of the primary reporting documentation on construction according to the order of drawing up and the resulted calculations to requirements of regulatory legal acts in the field of construction (the customer must provide contractual documentation (contracts and appendices to them, additional agreements, etc.), as well as design estimates and primary reporting and production documentation (forms KB-2v, KB-3, information write-off materials, work log, inspection reports covert work, test reports, etc.).
  • on compliance of real estate objects with design and technical documentation for their construction (repair, reconstruction) and requirements of normative legal acts in the field of construction (town-planning, fire-fighting, sanitary-hygienic, etc.);
  • compliance of the performed construction works (separate elements of objects, constructions, products, materials) with design and technical documentation and requirements of normative-legal acts in the field of construction (SBC, building codes and regulations (SNiP), standards, technical conditions, etc.) (the customer must provide to the expert design and primary reporting and production documentation for the construction of the object, a document on the commissioning of the construction object, materials of technical inventory for the object, standards and technical conditions for the manufacture of structures, products and materials, etc.).

 

To address issues related to determining the technical condition (degree of physical wear), accident rate, capital group, category of complexity, degree of fire resistance of real estate, as well as determining damage and destruction of the object and its structural elements and their causes, the expert must provide design documentation for the construction of the facility, a document on its acceptance into operation, technical inventory materials, acts and reports of previous inspections and research, etc.

 

To resolve the issues of determining the technical feasibility of distribution (allocation of shares; determination of the order of use) of real estate (residential buildings, apartments, commercial and industrial facilities) and provide options for such distribution, the expert must provide title documents to the property , data on the shares of co-owners, a document on the commissioning of the object, technical inventory materials, data on the actual use of real estate.

If the body (person) that appointed the expertise (involved the expert) considers it necessary to take into account when preparing options for the division of the proposal of the participants in the trial, such proposals must be set out in the document on the appointment of the examination ( involvement of an expert).

  • Do the volumes and cost of actually performed construction works (repairs, reconstruction) of the objects correspond to the volumes and values ​​determined by the design and estimate or primary reporting documentation on construction?

  • Does the primary reporting documentation (forms KB-2v, KB-3, etc.) on construction (repair, reconstruction) meet the requirements of regulations in the field of construction in the order of preparation and calculations? If not, what are the discrepancies?

  • What type of construction (new construction, reconstruction, overhaul, etc.) is actually performed on site?

  • Is the object (result of work performed) real estate?

  • What is the degree of construction readiness of the unfinished facility?

  • What is the capital group (complexity category, degree of fire resistance) of the object?

  • What is the technical condition (degree of physical wear and tear) of the real estate object (buildings, structures, etc.)?

  • Is the real estate object (building, structure) in an emergency?

  • What damage to the object (buildings, apartments, premises, finishes, etc.) occurred as a result of flooding, fire, natural disaster, mechanical impact, subsidence in the forged areas, etc.

  • What is the technical cause of damage and destruction of real estate (elements, structures, utilities, etc.)?

  • What is the cost of repair and construction work, which is necessary to eliminate damage due to flooding, fire, natural disaster, mechanical impact, subsidence, etc.?

  • What is the amount of material damage to the object (building, apartment, room, decoration, etc.) due to flooding, fire, natural disaster, mechanical impact, subsidence, etc.?

  • What is the functional purpose of the premises? Do the premises of the house belong to non-residential (auxiliary)?

  • Is it technically possible in accordance with the requirements of regulations in the field of construction to divide (allocate a share; determine the order of use) of real estate in accordance with the shares of co-owners (specify shares)?

  • What options for the distribution (allocation of shares; determination of the order of use) of real estate can be determined in accordance with the shares of co-owners (specify shares) and the requirements of regulations?

  • Does the building belong to the category of religious buildings in terms of architectural solution (style): temples, church buildings? (This issue can be resolved by conducting a comprehensive examination with the involvement of relevant specialists.)



 

Terms of service

The approximate terms are:

  • for forensic examinations - 60 days;
  • for expert research - 10 days.

The exact terms will be calculated at the time of order, taking into account the scope of the study and the current workload of specialists within the limits provided for paragraph 1.13. Section I "Instructions on the appointment and conduct of forensic examinations and expert research", approved by the Order of the Ministry of Justice of Ukraine 08.10.1998 № 53/5.
