Automotive and transport and commodity expertise- is a study in which the market value of wheeled vehicles, their components, as well as the amount of material damage caused to the owner or possessor of wheeled vehicles, their components due to damage to the latter. The auto-commodity and transport-commodity examination may also be preceded by questions about the components of the main task or related to it, if such questions are related to the purchase and operation of wheeled vehicles.

The examination is carried out after the submission by the body (person) who appointed it (involved) the expert (s), materials drawn up in accordance with the requirements of procedural law and the Instruction on the appointment and conduct of forensic examinations and expert studies.

Automotive examination is most often carried out after a traffic accident, due to which it may be necessary to assess the vehicle, for example, to provide an expert opinion to the insurance company.

Automotive and transport and commodity expertise allows for a comprehensive analysis of damage to vehicles, which will provide an opportunity to determine the amount of damage and, accordingly, the cost of monetary compensation for material damage.

When carrying out legal transactions with motor vehicles, if it is necessary to determine the value of material damage after an accident, vehicle owners turn to specialists of expert institutions in the field of motor goods. In the event of property disputes and in the investigation of offenses related to the operation of vehicles, the courts, the prosecutor's office, investigative bodies, and lawyers apply to expert institutions.

The list of the main directions of automotive expertise, which our specialists work on, is not exhaustive. We are also ready to consider other specific situations for the possibility of conducting a car examination. There are many such situations in which it may be necessary to conduct an examination of the car. These are: road accident, car theft, damage to the car by accident or due to the actions of third parties, etc.

The expert opinion on determining the cost of equipment repair, which is issued to the customer, has the status of an official document of evidentiary value and can be used in court. The acts of examinations, drawn up as a result of their conduct, relating to the determination of the cost of equipment repair, are accepted as evidence by all arbitral tribunals, including foreign ones.

The result of such examination is an expert opinion issued to the customer, is the basis for payment by insurance companies or the perpetrator of the accident compensation determined during the examination, as such conclusion has the status of an official document of evidentiary value and can be used in court. The acts of examinations, drawn up as a result of their conduct, relating to the determination of the cost of equipment repair, are accepted as evidence by all arbitral tribunals, including foreign ones.


Approximate list of issues to be solved, according to the Scientific and methodological recommendations on the preparation and appointment of forensic examinations and expert studies:

  • What is the market value of the vehicle (indicate its make, model and state registration number) on the valuation date (indicate the date on which its value is determined)?
  • What is the value of the vehicle (indicate the make, model of the vehicle, identification number), its components, imported into the customs territory of Ukraine, on the date of assessment (indicate the date on which its value is determined)?
  • What is the market value of agricultural and construction machinery? Note: the cost of equipment equipped with a power unit and self-propelled chassis, including tractors, combines, etc. is determined.
  • What is the value of the loss of commodity value of the vehicle on the valuation date (indicate the date on which its value is estimated)?
  • What is the disposal value of the vehicle (indicate its make, model and state registration or identification number) on the valuation date (indicate the date on which its value is estimated)?
  • What is the scrap value of the vehicle (indicate the make, model and state registration or identification number) on the valuation date (indicate the date on which its value is estimated)?
  • What is the liquidation value of the vehicle (indicate its make, model and state or identification number) on the valuation date (indicate the date on which its value is estimated)?
  • What is the cost of material damage (damage) caused to the owner of the vehicle (indicate the name, patronymic of the owner, brand, model of the vehicle, its state registration number) as a result (indicate the event that caused the material damage) on the date of assessment (indicate the date on which the value is estimated)?
  • Is the vehicle equipped in accordance with the regulatory and technical documentation of the manufacturer? If not, what exactly is understaffing?
  • What is the date of manufacture of this vehicle (its component)? What type does this engine belong to, what are its main characteristics?
  • Is it possible to carry out repair and restoration work on a damaged vehicle (its components)?
  • If possible, what is the scope, nature and cost of these works on the valuation date (indicate the date on which the property is valued)?
  • What is the value of the coefficient of physical wear of the components of the specified vehicle?
  • What is the value of the market value of the vehicle?
  • Do the performed repair and restoration works meet the regulatory requirements?
  • What characteristics (including type) does the vehicle meet according to the Ukrainian Classification of Goods for Foreign Economic Activity?



In addition to the above studies at the request of customers, owners of wheeled vehicles, experts-automotive experts can provide the following consulting services:

  • Participation of experts in the inspection of the vehicle and the preparation of the act of technical inspection of the car, indicating the nature and extent of damage and photographing the objects of study (This procedure further increases the possibility of obtaining a full insurance payment);
  • Conducting advisory calculations of the cost of repairs and material damage caused to the owner of the vehicle without inspection of the vehicle on the materials provided by the customer (Allows you to assess the judicial prospects of the case and determine the approximate insurance payment).



What documents (information) are needed for the event?

The expert is provided with the vehicle and documentation related to its registration, materials of the investigation of the event that caused the material damage, as well as documents that contain other initial data necessary to address the issue.

Required documents:

1) A copy of the vehicle registration certificate (the original must be provided when inspecting the car);
2) A copy of the passport or passport data of the customer for the contract;
3) Company details, information about signatories (for legal entities);

You may also need other documents (information) depending on the specific circumstances of your situation and the issues planned for the study.

* If necessary, the call of interested persons for technical inspection of the vehicle is carried out by the customer of the examination, indicating the date, place and time of the inspection (after coordination with the expert).

* The body (person) that appointed the expertise (involved the expert) must ensure the possibility of inspection of the vehicle and appropriate safe conditions (lighting, free access, the possibility of inspection of the vehicle from different angles, etc.).



What document will be obtained as a result?

The conclusion of expert auto-commodity research or the conclusion of the expert (if judicial examination was carried out) is provided. When conducting a forensic examination, the requirements of procedural legislation regarding the signature on criminal liability and instructions on information about court proceedings are also taken into account.

To conduct the study, the expert is provided with the vehicle and documentation related to its registration, materials of the investigation of the event that led to the material damage, as well as documents that record other initial data necessary to address the issue.





 

Terms of service

The approximate terms are:

  • for forensic examinations - 60 days;
  • for expert research - 10 days.

The exact terms will be calculated at the time of order, taking into account the scope of the study and the current workload of specialists within the limits provided for paragraph 1.13. Section I "Instructions on the appointment and conduct of forensic examinations and expert research", approved by the Order of the Ministry of Justice of Ukraine 08.10.1998 № 53/5.
